Trademark Registration

In addition to providing copyright litigation, trademark litigation, trade secret litigation and patent litigation services, the lawyers at Garlin Driscoll Howard provide the filing of trademarks with the United States Patent and Trademark Office.  Those filings are provided for a flat legal fee of $500, plus filing fees.  That flat rate includes responding to two Office Actions, with the exception of any Office Action(s) alleging consumer confusion.  In such event Garlin Driscoll Howard will respond at the request of the client at its standard hourly rates.

Trademark Oppositions   

Thomas Howard also has significant experience as a trademark opposition attorney. In the event that your trademark is accepted for registration and a third party files a trademark opposition with the Trademark Trial and Appeals Board, or should another party’s trademark be accepted for registration you wish to oppose such registration, Attorney Howard has significant experience litigating trademark oppositions before the Trademark Trial and Appeals Board.

Recent Intellectual Property News

  • In September 2007, Thomas Howard went to trial in Denver District Court and obtained a judgment for breach of contract and violation of the Colorado Uniform Trade Secret Act and obtained damages and attorneys’ fees totaling over $70,000.  The court further issued an order for permanent injunctive relief barring the defendant’s use or disclosure of attorney Howard’s client’s trade secrets.
  • In April 2007, Thomas Howard obtained a court order in Boulder County District Court providing permanent injunctive relief barring a defendants’ use or disclosure of a clients’ trade secrets.
  • In 2006, Thomas Howard successfully represented a large national sporting goods provider in the United States Federal Court for the District of Colorado in a dispute involving claims of trademark infringement and patent infringement.  The matter was successfully mediated immediately subsequent to the federal court’s denial of the opposing party’s motion for summary judgment.
  • In 2005, Thomas Howard successfully represented Nova Group, Inc. d/b/a Trilogy Studios, Inc. in the United States Federal Court for the District of Colorado in Huntsman v. Soderbergh,  an action involving multiple claims filed by nine major studios and 15 directors pursuant to the Copyright Act and the Trademark Act. The Directors/Studios attempted to bar Trilogy Studios from marketing software allowing consumers to preprogram a DVD player to skip and/or mute specified sections of a film stored on a DVD.  This lawsuit led to the Congressional passage, in April 2005, of the Family Movie Act of 2005, which modified both the Copyright Act and the Trademark Act, explicitly allowing for the sale of the skip/mute software designed by Trilogy Studios.  Subsequent to the passage of that Act, in July 2005, all claims raised against Trilogy Studios were dismissed.
  • Attorney Howard successfully represented a Colorado software manufacturer in a copyright infringement lawsuit involving the copying, distribution and sale of the clients’ source code.    
  • Attorney Howard successfully represented Young Electric Sign Co., a nationally sign design firm, in the United States Federal Court for the District of Colorado in a copyright infringement action involving the unlicensed copying and use of its architectural works.
  • Attorney Howard recently defended a party based in the People’s Republic of China in a lawsuit involving claims of theft of trade secrets.  The matter was successfully settled immediately subsequent to discovery.
  • Attorney Howard recently successfully represented the plaintiff in the United States Federal Court for the District of Colorado in a trademark infringement suit involving trademarks being used without license on the Internet for the purpose of advertising.
  • Attorney Howard recently successfully represented an international filmmaker in the United States Federal Court for the District of Colorado in a copyright infringement suit involving copyrighted works infringed through unlicensed distribution and sale over the Internet.
