Colorado attorney V.S. Koelsch is an experienced intellectual property and clean technology attorney who practices intellectual property counseling, patent litigation, patent post-grant procedures, as well as copyright, trademark, trade secret litigation.  Ms. Koelsch is also experienced in the sale, acquisition, and licensing of intellectual property and mergers and acquisitions of technology-based companies.

Ms. Koelsch has conducted litigation, transaction, and patent prosecution in technologies involving mechanical issues (fuel filters, robots, warehouse storage technologies); semiconductors (fabrication); data compression algorithms (JPEG); software (internet technology, e-commerce; cloud, virtual computers); oil and gas (technologies for extraction of shale oil); financial products (stored value products and backend platforms); telecommunications (least cost routing, interactive voice response, presence); and clean technology (energy meter, power management), among others.  

Prior to joining the Firm, Ms. Koelsch served as Chief IP Counsel to a telecommunications company with over $1B in annual revenue where she managed the litigation, prosecution, and maintenance of intellectual property.

Some of the recent matters in which Ms. Koelsch has resolved or is currently involved include:

A successfully resolved patent litigation dispute involving a mechanical device; prevailed in maintaining Colorado-based suit in Colorado and defeating a Section 1404 Motion to Transfer to defendant's forum;

A matter involving the alleged infringing use and copying, without license or permission, of copyrighted works and trade secrets pertaining to commercial nutritional products; prevailed in removing action to the District Court for the District of Colorado from Colorado State Court pursuant to 28 U.S.C. 1454 of the America Invents Act;

A pending matter involving the alleged breach of an employment contract and infringing use of copyrighted home inspection reports and violation of the Defend Trade Secrets Act;

A pending matter involving the alleged infringing use of copying, without license or permission, of copyrighted works pertaining to vacation travel videos.

Previous engagements:

Counseled clients on the purchase and potential enforcement of patent portfolio related to a system of distributed energy management;

Counseled clients on the patent prosecution of shale energy patents;

Prevailed as appellant on appeal to the Court of Appeals for the Federal Circuit, reversing finding of non-infringement of gift-card patent for insufficiency of evidence;

Managed due diligence for intellectual property, including patents, trademark, and copyrights for the sale of cloud computing business.

Thomas Howard is an experienced trial lawyer practicing with an emphasis in intellectual property disputes (including copyright, trademark, trade dress, trade secret, Web site infringements and other Internet-related disputes) as well as complex civil litigation (including breach of contract, interference with contract, breach of fiduciary duty, conspiracy, fraud, fraudulent transfer, trespass, negligence and nuisance).
In addition to representing clients involved in litigation, Thomas Howard frequently negotiates and drafts intellectual property-related agreements, including nondisclosure and license agreements.
